By downloading, installing, or using the GabbyBattles application ("App") or visiting gabbybattles.com ("Website"), you agree to be bound by these Terms of Service ("Terms"). If you are a parent or guardian creating an account on behalf of a child, you agree to these Terms on their behalf. If you do not agree to these Terms, do not use the App or Website.
The App is intended for use by children ages 6–14 under the supervision of a parent or guardian. Children under 13 may only use the App with verifiable parental consent, in compliance with COPPA. Parents and guardians must be at least 18 years old to create an account.
To access certain features, you must create an account. You agree to provide accurate information, keep your password confidential, and notify us immediately of any unauthorized use of your account. You are responsible for all activity that occurs under your account.
The Free plan is available at no cost. The Family Plan is billed monthly or annually as selected at signup. Subscriptions automatically renew unless cancelled before the renewal date. You may cancel at any time through your account settings. No refunds are provided for partial billing periods, except as required by applicable law. We reserve the right to change pricing with 30 days' notice.
You agree not to: (a) use the App for any unlawful purpose; (b) attempt to gain unauthorized access to any part of the App or its systems; (c) upload, transmit, or share content that is harmful, offensive, or inappropriate for children; (d) reverse engineer, decompile, or attempt to extract the source code of the App; (e) use the App to collect information about other users without their consent; or (f) interfere with the operation of the App or its servers.
All content in the App and on the Website — including the GabbyBattles name, Gabby mascot character, VibeVid content, lesson materials, battle questions, and all associated trademarks — is owned by GabbyBattles LLC and protected by U.S. and international intellectual property laws. You may not reproduce, distribute, or create derivative works from any GabbyBattles content without our express written permission.
If the App allows users to submit content (such as usernames, battle challenges, or messages), you retain ownership of that content but grant GabbyBattles a non-exclusive, royalty-free license to use, display, and distribute it within the App. You represent that any content you submit does not violate any third-party rights.
The App is provided "as is" and "as available" without warranties of any kind, express or implied. GabbyBattles does not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that the App will meet your specific educational requirements or produce specific academic outcomes.
To the maximum extent permitted by applicable law, GabbyBattles LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total liability to you for any claim arising from these Terms or your use of the App shall not exceed the amount you paid to us in the 12 months preceding the claim.
We may suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time through the App settings. Upon termination, your right to use the App ceases immediately. Sections 6, 8, 9, and 11 survive termination.
These Terms are governed by the laws of the State of [State to be determined upon LLC formation], without regard to its conflict of law provisions. Any dispute arising from these Terms shall be resolved through binding arbitration in accordance with the American Arbitration Association's Consumer Arbitration Rules.
We may update these Terms from time to time. We will notify you of material changes by email or through the App at least 14 days before they take effect. Continued use of the App after that date constitutes acceptance of the updated Terms.
